These Terms and Conditions govern your use of Shubhvite for vendor discovery, bookings, and event planning services. By making a booking through the Platform, you agree to these terms along with the vendor's cancellation and refund policy.

1. About Shubhvite

Shubhvite is a digital platform that helps users plan and celebrate events by providing tools for digital invitations, guest management, gifting, photo sharing, and vendor discovery. The platform is owned and operated by Nagothu Digital Services Private Limited ("we", "us", "our", "Company") and is accessible via our website, mobile application, and related services (collectively, the "Platform").

2. Acceptance of Terms

By accessing or using the Shubhvite Platform, registering an account, making a booking, or transacting through our gifting or vendor services, you ("User") agree to be bound by these Terms and Conditions, our Privacy Policy, and any additional guidelines or policies published on the Platform.

If you do not agree to these terms, please discontinue use of the Platform immediately.

These terms form a legally binding agreement between you and Nagothu Digital Services Private Limited. Please read them carefully before proceeding.

3. User Accounts

• You must be at least 18 years of age to create an account or make a booking.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate, current, and complete information during registration and keep it updated.
• Nagothu Digital Services Private Limited reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
• You may not transfer or share your account with any third party.

4. Vendor Services and Bookings

Shubhvite connects users with independent third-party vendors including but not limited to makeup artists, photographers, caterers, decorators, and event planners (collectively, "Vendors").

• Shubhvite acts as a marketplace and technology intermediary. We are not the vendor providing the service and are not a party to the service agreement between you and the vendor.
• All bookings are subject to vendor availability and confirmation.
• Service details, timings, and delivery are agreed between you and the vendor. Shubhvite is not liable for any failure by a vendor to deliver services as described.
• Shubhvite does not guarantee the quality, suitability, or availability of any vendor service listed on the Platform.
• In case of a dispute with a vendor, Shubhvite may assist with mediation but does not assume liability for outcomes.

5. Payments and Pricing

• All prices displayed on the Platform are in Indian Rupees (₹) unless otherwise stated and are set entirely by the respective vendor.
• Shubhvite does not charge any platform fee or commission to users. The amount you pay at checkout goes directly toward the vendor's service.
• Payments are processed securely through third-party payment gateways. Shubhvite does not store your card or banking information.
• The amount charged at checkout is the full payment for the selected service and slot unless otherwise specified by the vendor.
• Transactions are encrypted with bank-level security. Shubhvite is not liable for errors or failures caused by payment gateway outages beyond our control.
• GST and applicable taxes, where applicable, will be reflected at checkout.

6. Cancellation and Refund Policy

Cancellation and refund terms are set entirely by the individual vendor and may vary for each service. Shubhvite does not impose a platform-level cancellation or refund policy. By booking a service, you agree to the vendor's specific cancellation and refund terms as communicated at the time of booking.

• Cancellation by user: Requests must be submitted via the Platform or directly to the vendor within the timeframe specified in the vendor's policy.
• Refund eligibility: Whether a refund is applicable, and the amount thereof, is determined solely by the vendor's policy. Shubhvite will facilitate the refund process but is not liable for the vendor's refund decision.
• No-show: If you fail to use the booked service without prior cancellation, refund eligibility is governed by the vendor's policy.
• Vendor cancellation: If a vendor cancels a confirmed booking, Shubhvite will endeavour to facilitate a full refund or assist you in rebooking with an equivalent vendor.
• Refund processing: Once a refund is approved by the vendor, Shubhvite will process it within 7–10 business days to the original payment method.
• No platform fee: Shubhvite does not charge any platform or convenience fee. There are no deductions from your payment beyond what the vendor charges.

7. Platform Conduct

You agree not to:

• Use the Platform for any unlawful, fraudulent, or harmful purpose.
• Upload or share content that is defamatory, obscene, abusive, or infringes third-party rights.
• Attempt to reverse engineer, scrape, or systematically extract data from the Platform.
• Misrepresent your identity, impersonate another person, or provide false information.
• Use the Platform to send unsolicited communications or spam.

Nagothu Digital Services Private Limited reserves the right to remove content, restrict access, or terminate accounts that violate these conduct standards.

8. Intellectual Property

All content on the Platform including logos, design, text, graphics, software, and trademarks are the property of Nagothu Digital Services Private Limited or its licensors and are protected under applicable intellectual property laws.

You may not reproduce, distribute, or create derivative works from Platform content without prior written consent from Nagothu Digital Services Private Limited.

User-generated content (such as photos uploaded to the Platform) remains owned by the user. By uploading content, you grant Shubhvite a non-exclusive, royalty-free licence to display and use that content solely for the purpose of providing Platform services.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• Shubhvite provides the Platform on an "as is" and "as available" basis without warranties of any kind.
• Nagothu Digital Services Private Limited shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
• Our total liability for any claim arising out of or relating to these terms shall not exceed the amount you paid for the specific transaction giving rise to the claim.
• We are not responsible for events beyond our reasonable control including natural disasters, internet outages, or third-party service failures.
• We are not liable for the actions, omissions, or service quality of any vendor listed on the Platform.

10. Privacy

Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in the Privacy Policy.

11. Governing Law

These Terms and Conditions are governed by the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.
